  *The Importance of Indigenous Rights in Leadership: A Focus on Chief Ministers like Stephen Kalong Ningkan and Tawi Seli*

  Richard commented on how Taib Mahmud and Rahman Yakub were able to maintain power for 44 years as Sarawak's chief minister when Melanaus were only 5% of Sarawak's population. And when talking about the administration of Adenan and Abang Johari as Chief Minister of Sarawak (they are both Malays), the total time that the Malays and Melanaus dominated Sarawak politics was 54 years.

  Richard got the First Chief Minister Stephen Kalong Ningkan and the second Chief Minister Tawi Seli too honest and naive in politics. They are also not highly educated but have the principle of defending the rights of Sarawak. This is not liked by UMNO as the government in the federation. UMNO cooperated with Rahman Yakub and Taib to seize the rights of Sarawak in return for Rahman Yakub and Taib remaining in power. The same policy was used during the administration of Adenan and Johari openg until now. The Iban Dayaks in particular are confused, they are said to be part of the government when they have representatives in the PBB (PESAKA) but that is just a mask.

  The Dayaks in the PBB are only given small ranks and positions but the greatest power is held by the Malays and Melanaus. The clearest evidence is that the Malay and Melanau areas are advanced with various facilities while the Dayak areas remain backward. The Dayaks remain poor but the Malays and Melanaus work with capitalists to build dams, logging and oil palm plantations that take away the Dayaks' land.

  Richard asked the Dayak people to realize this fact and stop supporting GPS. Only then can Dayak become Chief Minister again. The real question is not which race becomes the Chief Minister, but the most fair and honest Chief Minister- Said Richard.

  *The Agrovoltaic Farming Initiative in Baram: Ensuring Land Rights and Sustainability*

  Sarawak markets will have access to both sustainable energy and poultry prices for decades to come once a privately-funded 1,000 MWh Solar Plant integrated with Sustainable Animal Feed Economics (SAFE) in Baram is completed. Premier Sarawak Abang Johari Tun Openg was recently briefed on the investment and development of this project by Planet QEOS and China Machinery Engineering Corporation (CMEC). The patent-applied technology powering the SAFE Agrovoltaic farm will enable the energy farm to generate annually 1,430 GWh of energy; 170,000 MT of carbon neutral animal feed; and 25 million carbon neutral broiler chickens at fixed, predetermined and sustainable prices for 30 years.

  Barnie Lasimbang comment on the agrovoltaic farm which is a combination of agro griculture and solar energy. This solar farm needs a huge area to install solar panel to gain bigger energy. So there shouldn’t be any other activities in these area.

  He said that the latest trend installation of this solar also for plantation such as poultries or livestocks. In olden days solar panel were place very close to each other that cause no sun ray underneath . New ways to install solar panels are to leave some space. Thus allows sun rays underneath. So underneath solar panel now can plant vegetables or rearing of lives stocks, so not to waste the areas .

  When he heard this program to be introduce in Baram area, he then thinks this is not the very first time done in Malaysia. This kind of program also been done in Perak and Selangor, where aquaculture and rearing of lives stocks.

  But not sure if the area would cause land grabbing. Its all depand on approval. But indeed the areas are involve NCR, there should be consent from the communities

  *Fair Trial or Political Interference? Controversy Surrounding Clare Rewcastle-Brown's Trial*

  Sarawak Report editor Clare Rewcastle-Brown was sentenced to two years in absentia by a Malaysian court for defaming Sultanah Nur Zahirah of Terengganu. The verdict was delivered by Magistrate Nik Mohd Tarmizie Nik Mohd Shukri after she was found guilty under Section 500 of the Penal Code. The trial was conducted in her absence, and an arrest warrant was issued earlier for her failure to attend proceedings.

  This case has attracted domestic attention, and Jeffrey asked whether Clare was given a fair chance to defend herself. He questioned whether the accusations were truly defamation. Jeffrey pointed out that this case originated from the previous government and has dragged on for years. He inquired whether Clare was given the opportunity to defend herself and whether the trial was transparent. Otherwise, issuing a verdict against Clare would be unfair.

  He said this case has garnered international attention, with everyone watching whether Malaysia's judiciary handles it fairly and transparently. Jeffrey mentioned that PM Anwar Ibrahim talked about reform, but after over a year in power, something has hindered him, causing reforms to stall. He pointed out that it's clearly the influence of the "shadow UMNO," especially evident in Zahid's DNA and Najib's 1MDB case where they received pardons reducing their prison sentences and fines.

  He emphasized that the people are waiting for reforms under a Unity government, including judicial fairness and transparency. Clare's case has also put Malaysia in the spotlight, raising concerns about freedom of speech becoming increasingly restricted. He hopes Malaysia's judiciary will give Clare a fair trial.

  *Investigation under the Sedition Act against Tony Pua- Shameful*

  N.Surendran strong comments against the use of the sedition act against Tony Pua are fair and in the public interest. Tony Pua has the right to speak and the right to speak is guaranteed by the federal constitution, so using oppressive laws against the public is a mistake. he direct his criticism towards the Prime Minister and the government because PKR/PH has been the backbone party of the government since 2018 (22 months) and now - after GE15, it has been over a year, there is no clear reform, hardly a reform at all.

  On the other hands what happens Oppressive laws are enforced. PH sold in their campaign that they will do reforms. He don't think there is any reform at all. If you want to list the oppressive laws that are being enforced now, The list will be very long.

  In relation to the decision of the Pardon Board that reduced the sentence against Najib. There should be no confusion. At a glance we know that Agung/King should follow the advice given as required by the federal constitution except in the matter of appointing the PM, dissolving parliament and calling a meeting of the council of kings related to the privileges of the kings. The pardon board has advised that Najib serve the full sentence. So the advice should be followed by Agung/King. But that is not the case and it clearly violates the Federal Constitution.

  A 2-year prison sentence against the founder of Sarawak Report for allegedly slandering the Sultanate of Terengganu. I cannot comment in detail on the court process that took place. But for a long time we have been fighting to abolish section 500 of the penal code which is an oppressive law that suppresses freedom of expression. Not only Clare Brown, but all Malaysians have the right to speak based on fundamental rights and public interest.- I have left PKR- I want Malaysians to choose a party that really does reforms without delay

  *Projek Sama urges AG to ensure pursuit of Najib’s pending cases without DNAA*

  PROJECT Stability and Accountability for Malaysia (Projek Sama) has urged the Attorney General (AG) to formally commit to vigorously pursuing the three pending cases against former Prime Minister Najib Razak.

  Ngeow said that, Projek Sama aimed to prevent any potential application by the Attorney General’s Chambers (AGC) for the discharge of the cases.

  Expressing concerns over AG Ahmad Terriruddin Mohd Salleh’s involvement in Najib’s partial pardon, Projek SAMA emphasized the importance of maintaining the ongoing charges against Najib.

  Projek SAMA call is warranted given the AGC’s track record, exemplified by cases such as Deputy Prime Minister Ahmad Zahid Hamidi and former 1Malaysia Development Bhd (1MDB) CEO Arul Kanda Kandasamy, where both were either discharged without acquittal or acquitted.

  Furthermore, Projek Sama asserted that if AG Terriruddin fails to provide this public assurance, he should consider resigning in the public interest.

  To address systemic issues, the Madani government must expedite the separation of the office of Attorney General and the Public Prosecutor and ensure the independence of the Malaysian Anti-Corruption Commission (MACC) from political influence.

  On February 2, the Pardons Board reduced Najib’s jail term and fine in the SRC International misappropriation case. However, Najib still faces three pending cases, including an RM27 million money laundering trial related to SRC International and the 1MDB corruption trial.

  Additionally, the former premier is charged with criminal breach of trust alongside former Treasury Secretary-General Mohd Irwan Serigar Abdullah involving RM6.6 billion in payments to the International Petroleum Investment Company, with the trial set to commence on June 4.

  *Severe Flooding Strikes Five Penan Villages along Linau/Belaga River: Should the Sarawak Government Construct More Dams?*

  Ngang Kuja reported that 5 penan villages have been flooded by the Linau river which has been overflowing with flood water for the past 4 days. The villages involved are Long Abit, Long Kajang, Lusong Laku, Long Lidem and Long Tanyit.

  According to Ngang Kuja, this is an extraordinary flood as far as I know as long as I live in the linau area. We lost everything like rice crops, livestock and houses. The long house of Long Kajang is no longer habitable because it has almost collapsed due to being washed away by the water. When asked if logging is the cause of this extraordinary flood. Probably not, he said- because there is no more active logging in our area. But I expect it is the effect of global climate change. Because the part of Indonesia that borders us is also badly affected by the flood. We are asking for immediate help. The aid sent to us at this time can only cover our lives for 2 days only. It is difficult for us to connect with the outside world because the telephone line is not stable. Long Kajang 25 doors and 38 households.   Regarding Taib, many previously believed that anyone holding the title of Tun is immune from the law. This is incorrect because every offender will face the courts. As we know, Tun Mahathir and Tun Daim will also face legal action for their mistakes, as will Taib Mahmud.

  Abun Sui argues that the Najib pardon case represents a separation of powers among Malaysia's judiciary, legislative branch (Parliament), and executive administration by the Malaysian government. Within the Malaysian constitution, there is also the royal pardon institution. The executive branch has apprehended Najib and will bring his case to the judiciary for trial. This pardon institution is an independent body where the government cannot interfere but is granted authority under the Federal Constitution under Article 42, and we cannot blame anyone for this matter. Many understand the provisions under Article 42, and many point fingers at PMX as the Prime Minister and blame the Unity government, even though Najib's pardon case is under the authority of the Yang di-Pertuan Agong. It is unfair if the pardon institution under the Agong makes the decision, but the people blame PMX. We must respect this system. However, it is hoped that there will be amendments to this pardon institution in the future if it receives one-third in Parliament to change the law by this pardon institution. Thus, we as citizens must accept the decision made under the Agong.

  *Peter believes Police are investigating Raghad for allegedly stealing Taib's property*

  Update related to the news of Tun Taib Mahmud being forcibly taken out by his wife Raghad Kudi from Normah Specialist Hospital in Kuching while receiving treatment in the ICU. Several police reports were made and confirmed that it really happened. However, the Sarawak police do not allow the public to speculate about it.

  According to Peter, what happened was a fight over Taib's property. Raghad made preparations to pack hundreds of boxes of Taib's property to be taken abroad, a viral photo shows that. This caused unease among Taib's children. They accused Raghad of stealing their father's property. Depressed by that, Raghad brought Taib home from the hospital's ICU so that he could take a picture with him with the treasures that had been packed in the hundreds of boxes, this will justify that it is not stolen property,it is a gift from Taib. According to Peter again, since 2014, Raghad did not allow Taib's children to meet their father.

  The follow-up, at 1.21am this morning, through a post on his Instagram account, Raghad denied the matter and asked to stop the bad suspicions against him. She said, she will not run away from the country and will continue to be in Sarawak - I am indeed a foreigner, but I am a Malaysian citizen - she said.

  Raghad also denied reports that Taib was kidnapped from the hospital. He took Taib out with the nurse's permission. Peter questioned Raghad's statement by asking a question. Who has the authority to discharge patients? Doctor or nurse. With this irresponsible action, Peter urged the Sarawak government to revoke the Malaysian citizenship given to Raghad. The native status owned by Raghad can be misused to increase the amount of wealth, get involved in politics or distribute property to his relatives. Don't be surprised if members of the Raghad family dominate Sarawak's politics or wealth. Said Peter John Jaban.

  Dr Michal Teo, as a medical practitioner of 50 years, is deeply disappointed by Ragad's actions in taking Pehin Sri Taib Mahmud, who was receiving treatment at Normah Hospital. This is highly endangering Taib's health as he was taken home and unable to receive proper medical care. Taib Mahmud's health history includes a cancelled colonoscopy while seeking treatment in Singapore, and in the last ten years, he has been suffering from memory loss, requiring more careful attention from the hospital. Ragad's actions in taking Taib out can also warrant police action.

  *Najib's Pardon: Still on Criminal Status*

  On the issue of Najib's pardon, Voon Lee Shan expresses his opinion that according to the law, the meaning of a pardon implies that one has been found guilty and subsequently pardoned for that guilt. Merely being released from prison does not constitute a pardon. This type of pardon leaves a record of guilt or criminal charges. Alternatively, a pardon can be granted without an admission of guilt. However, in Najib's case, the pardon serves to shorten his period of imprisonment, indicating that he is still considered a criminal. Nonetheless, he would be released after serving six years. According to prison procedures, if an inmate maintains good behavior, their sentence can be reduced by one-third. Therefore, if one-third of six years is deducted, Najib could potentially be released in approximately four years. Hence, Najib could be released sooner than expected.

  According to Pushpan, Najib does not deserve a pardon because he has been found guilty in a case where he misused his power to gain benefits for himself, his family and the political party he is president of. He got so many advantages that the sentence was shortened to only 6 years and a fine of RM50 million only. Where is the logic? Embezzled RM42 million but was fined RM50 million.   Shahrizal Denci, stated that such action is necessary to provide clarity on the definition of sedition to prevent its misuse.

  He said that, consider the investigation against Tony, the former Member of Parliament for Damansara, as something unreasonable. If it is true that he is being investigated for comments on Facebook related to the issue of pardoning Najib, then Muda call on the Ministry of Home Affairs to update the sedition laws so as not to waste authorities' time investigating trivial matters.

  He emphasize that It is clear in the Federal Constitution that every Malaysian citizen has the right to speak and express opinions as long as they do not touch on sensitive issues.

  Based on Tony comments on social media, are the feelings and sentiments of UMNO part of the sensitive issues? Can he not criticize or express opinions on this issue, especially in the context of the current government?

  Inspector-General of Police, Razarudin Husain, confirmed on Sunday that Tony was called in for a statement following allegations of insulting the royal institution in relation to Najib's pardon on Monday. The case is being investigated under Section 4(1) of the Sedition Act 1948 and Section 233 of the Communications and Multimedia Act 1998.

  Earlier, Tony was reported to have uploaded three posts expressing dissatisfaction with the leniency given to Najib. Sarcastically, he asked someone to send him to jail for a year and he would pay RM50 million in exchange.

  The war of words between supporters of dam building and anti-dam is heating up in Tutoh. Wednesday, Mulu assemblyman Gerawat Gala announced to the media that the majority of tribal leaders in Tutoh supported the GPS government's plan to build the Tutoh dam. Gerawat said that the residents agreed because they were aware of the economic benefits and the minimal impact on the environment. On January 30, 2023 - the tribal leaders, led by the area chief Tutoh Benedict Wak said, only a small group opposes the construction of the tutoh dam and they do not represent the voice of the local population, they are not in the village, do not attend meetings and are anti-development.

  Dennis explained that they are the largest group representing the people of Tutoh who are against the construction of the Tutoh dam. To date, more than 600 people have signed a petition against the construction of the dam.

  *Living Dam-Free: Nyegol's Example on mini hydro, eco-tourism and reforestation - the Possibilities for Other Communities*

  In 2007 the Sarawak government made a decision to build the Bengoh dam to supply clean water to the people of Kuching City. In 2010 Bengoh Dam was completed. Some villages were relocated because they were in the project area. But the villagers of Nyegol decided not to move and only moved to higher ground that was not flooded.

  Looking back on a decision made 17 years ago, Simo along with 15 other families do not regret to continue living in the dam area. They now inherit their family's NCR land of more than 5000 hectares. They cultivate a small part of the land by planting rice, fruit orchards, replanting trees and running a homestay.

  Besides that, Simo and his friends since 2 years ago have started planting 10 thousand trees of various species of tropical trees and now there are still 10 thousand more trees that are still in the nursery. Simo said that they get clean water supply from gravity pipes and work on a mini hydro dam with the help of the NGO Light Up Borneo, and the tree planting project in collaboration with SEB.

  This is a very intriguing phenomenon. Initially, the construction of the SEB dam forced several villages to relocate, but now they also recognize and support the village that is reluctant to move, and are involved in a planting project.

  Simo said that remembering what happened to them, the government's plan to build the Bengoh dam to supply water to the people of Kuching - has failed. Until now there is no pipe installation from the Bengoh dam to the City Center. They won when they took their case to court in 2014, and they got compensation.

  Simo said that they are grateful to Yb See Che How who helped them a lot.

  Garak Jalong, Head of Long Lawen Village, Belaga

  *Challenging Pointless Dam Projects: Mini Hydro's Two-Decade Triumph in Sustainable Energy in Belaga*

  As the Village Head, Garak does not agree with the way the GPS state government handles the dam construction project in the state. It is said that the residents of Sg. Belaga agreed that the Melata dam should be built in their area. According to Garak, the state government should not only ask for the approval of village heads or tribal leaders. The consent of the poor or common people is very important. Obviously in the past the construction of the Murum and Bakun dams disturbed the lives of the residents.

  Garak explained that Kampung Long Lawen did not agree to move to the new settlement of Bakun Sungai Asap, because the compensation value is too small, the land is only 3 acres for a family and it is expected that the poor family will not be able to pay the water and electricity bills.

  The residents of Long Lawen moved their settlements (long houses) to higher ground when the bakun dam began to fill with water. In this higher Settlement the residents built a mini hydro Dam with the help of NGO-Green Empowerment from USA.

  From 1999 to 2021, the residents of Long Lawen get electricity from this mini hydro dam, without having to pay electricity bills. In 2022 SEB supplies electricity to Long Lawen for free, in return for the land of Long Lawen residents who were not compensated by SEB- in the construction of the Murum hydroelectric dam.

  Since the construction of the Murum hydro-electric dam more than 10 years ago, most of the NCR land of Long Lawen residents is affected due to the construction of the project. However, until now SEB and the Sarawak government have not paid compensation for the land. An argument ensued when the government said that the valuation of the land was based on sec 6. But the residents insisted that the land was indeed their NCR land which was valid and should be paid using the land price of sec 18. This case has been brought to court. The residents of Long Lawen use the services of Lawyer Abun Sui Anyit. Residents are still waiting for a hearing date.

  Garak said that they still take good care of the mini hydro dam, because if SEB asks us to pay the electricity bill and we can't afford it, they will use the mini hydro dam again.

  Mr. James from the traditional village of Tukau Jaya

  *Marginalized Tukau Locals: GPS, Parabena, and Land Survey Disregard their Plight*

  James reports the current status of actions regarding cases of oppression by the Land and Survey department and Parabena. According to Mr. James, he and several villagers do not wish to pursue the case in court, although a few villagers still want to proceed with legal action against Parabena.

  James said that, he and several villagers have sent letters to the Premier of Sarawak, representatives, Parabena, Land and Survey, and various related offices to demand fair compensation. Mr. James and the villagers are unable to afford legal services to continue the case, so it is reasonable for them to seek compensation for the losses incurred on their crops and houses that they have built for over 20 years.

  Currently, they are only awaiting responses to their compensation demand letters.

  *UNDRIP Principles and Local Governance: Striving for Community Consensus*

  Deputy Minister II for Youth, Sports, and Entrepreneur Development Sarawak, Dr. Ripin Lamat, emphasized the importance of every member of the village, security, and development committee (JKKK) in strengthening the relationship between villagers and grassroots leaders. These leaders include the 'tuai rumah' (longhouse chieftains), village headmen, and 'Ketua Kaum' (neighbourhood chiefs).

  However, in contemporary times, many village leaders are appointed by YBs or politicians, leading them to become spokespersons for the GPS (Gabungan Parti Sarawak) and companies. This trend often results in chaos within the village, as these leaders prioritize their personal benefits, neglecting the rights of the villagers.

  Bill Juga highlighted that not all appointments of JKKK by YBs are necessarily bad, but issues arise when there is a lack of consensus within the community. He advised that adherence to the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), specifically in Article 4, commits the government to ensuring the self-determination rights of Indigenous Peoples.

  He further emphasized that in the past, leadership was often determined by qualities such as being a warrior, but nowadays, it differs significantly. Individuals with the ability to think critically or possess education should be considered for leadership roles. Bill Juga suggested that if the JKKK team is elected by the community, it would lead to less politicization and greater democratic representation.

  1. The appointment of TYT Sarawak is unconstitutional - according to PBK President Voon Lee Shan. The Sarawak Constitution should be amended so that the appointment of the Sarawak TYT does not require the intervention of people outside Sarawak (Agong/King or Prime Minister in the Federation).

  2. The case of the traffic police asking for bribes from 2 foreign tourists was investigated by Bukit Aman. The case is believed to occur in December 2023.

  3. Tycoon and millionaire Daim Zainuddin pleaded not guilty to failing to comply with the MACC notice to declare hate. There were 71 properties that failed to be declared by Daim. Including 38 companies, 25 real estate and hotel units, 7 luxury vehicles and 2 bank accounts. Daim was charged with deliberately giving a written statement under oath that did not comply with the terms of the SPRM notice dated 8 Nov 2023. He was charged according to section 36(2) of the SPRM Act 2009. Daim urged the public to oppose the PMX Anwar Ibrahim administration which he described as carrying out false and wrong reforms exercise power with selective prosecution.

  *Voon Raises Questions on Legitimacy: Is the 8th TYT Appointment Constitutional?*

  With the awarding of the letter of appointment by the Agong/King and the swearing-in ceremony of the TYT at the Sarawak state assembly at 3 pm 29 Jan 2024. The issue of the appointment of the 8th TYT Sarawak has been completed.

  But for PBK President - Voon Lee Shan, there are still too many unresolved issues. The question arises whether Tun Taib was fired or resigned? No official announcement from the state Astana in Kuching or Announcement by Istana Negara, no resignation letter submitted.

  Voon said that, before the appointment of the new TYT is made, the old (existing) TYT must resign first. Tun Taib's term of office still remains until Feb 2024, is Tun Taib forced to resign or refuses to resign, even though he is old, infirm and sick.

  Voon also raises another question – Is the appointment of the new TYT through discussion with the Premier of Sarawak? If that is, the Premier of Sarawak should bring the matter up for discussion in the Sarawak state assembly meeting. From the public information we know, that is not the case.

  Voon claims that what is happening now is turning his back on the Sarawak constitution or the appointment of the 8th TYT is unconstitutional. Voon suggested that Sarawak move to a more mature and democratic governance. That is by amending the Sarawak constitution so that the power to appoint Sarawak TYT is no longer given to the Agong/King.

  Second, The appointment of TYT must be through a motion and vote in the Sarawak state assembly. All parties have the right to nominate candidates in the Sarawak state assembly conference. According to Voon, Leo Mogie, Alexander Nanta Linggie and Richard Riout are also eligible to be considered for the post of TYT, apart from other parties who contributed a lot outside the political radar.

  Voon's final assertion is, if the Agong/King is found to be doing something that violates the constitution, he can also be prosecuted in a special court according to article 33(a) of the federal constitution.

  Jeffrey Ngui of MUDA Sarawak

  *5G's Limited Reach Interior: Prioritizing Fundamental Communication Networks*

  Jeffrery Ngui describes the statement claiming Malaysia's 5G as the fastest in the world as highly dismissive of the sentiments of the people in the digital age. Many in the rural areas of Sabah and Sarawak, according to his colleagues, will lose connectivity when returning to their villages. Jeffrey acknowledges the government's substantial investment in Telco towers in Sarawak but questions their functionality.

  Jeffrey Ngui also believes that there may be hidden hands from certain politicians in the internet projects in rural areas, aiming to obstruct telecommunication services to the people in those areas. Moreover, in semi-urban areas, the 5G network is reportedly unusable. Jeffrey suggests that it would be better to utilize the 4G network, funded by the people's money, rather than investing in 5G that doesn't fully function.

  *Neglected Roads and Forgotten Villages in Kota Marudu Sabah*

  On the road leading to SK Mengandai in Kota Marudu, a recent viral video highlighted the challenging conditions faced by primary school students and one of their teachers returning to their hostel. They had to spend the night at a farm hut due to the poor road conditions, especially during the rainy season. This issue is not new, but it has gained attention through social media.

  The villages in Magandai, located in the Kota Marudu area, face difficulties exacerbated by the inadequate road infrastructure. It is noteworthy that Kota Marudu, despite being one of the poorest districts in Malaysia, has Dr. Maximus Ong Kee Lee as its Member of Parliament, who is also a long-serving minister.

  The road, originally a logging road, has seen little to no maintenance since the logging company ceased operations for an extended period. Even Barnie, himself, has experienced such road conditions and spent nights on the roadside. The surrounding communities rely on oil palm companies for minor maintenance.

  Given the circumstances, there is a call for the Public Works Department and other state agencies to identify roads connecting to urban schools and prioritize the upgrading of these roads to ensure better accessibility and living conditions for the local residents.
