Kee Hui Yee, Ahli Jawatankuasa Undang-undang Perlembagaan Majlis Peguam – SOSMA BERTENTANGAN DENGAN HAK ASASI MANUSIA, HARI DIKAJI SEMULA DAN DIMANSUHKAN

Kenyataan menteri dalam negeri yang baharu Saifuddin Nasution Ismail bahawa tiada keperluan menyemak semula SOSMA amat mengecewakan menurut Kee Hui Yee.

Antara 10 perkara tersebut- berikut 3 daripadanya yang benar-benar tidak memberi keadilan kepada mereka yang ditahan atau dituduh;

Iaitu pihak polis boleh menahan mana-mana individu dan tak perlu dibawa ke mahkamah sehingga 28 hari. Ini menindas dan menjejaskan hak asasi manusia. Selain itu menurut Hui Yee Seksyen30 SOSMA memberi layanan tidak adil kepada tahanan. Tahanan boleh ditahan di penjara sehingga semua perbicaraan dan rayuan selesai di mahkamah. Bayangkan jika semua proses mahkamah melibatkan mahkamah tinggi, mahkamah rayuan dan mahkamah persekutuan memakan masa 5 hingga 10 tahun. Tahanan masih belum boleh dibebaskan. Dan perkara ketiga yang juga tak adil dalam SOSMA adalah saksi yang memberi keterangan atau bukti boleh disembunyikan identitinya oleh pendakwaraya. Ini menyukarkan pihak pembelaan mencabar keterangan yang diberi oleh saksi.

Dengan kelemahan-kelemahan ini. Wajar SOSMA dikaji semula dan dimansuhkan mana-mana bahagian yang bertentangan dengan hak asasi manusia.

Kee Hui Yee, Member of Bar Council Constitutional Law Committee – SOSMA IS AGAINST HUMAN RIGHTS, SHOULD BE REVIEWED AND REPEALED

The new home minister Saifuddin Nasution Ismail's statement that there is no need to review SOSMA is disappointing according to Kee Hui Yee.

Among those 10 things - the following 3 of them really do not give justice to those arrested or accused

That is, the police can arrest any individual and do not need to be brought to court for up to 28 days. This oppresses and undermines human rights. In addition, according to Hui Yee, Section 30 of SOSMA gives unfair treatment to detainees. Detainees can be held in jail until all trials and appeals are completed in court. Imagine if all the court processes involving the high court, the appeal court and the federal court took 5 to 10 years. Prisoners have yet to be released. And the third thing that is also unfair in SOSMA is that witnesses who give evidence or evidence can have their identity hidden by the prosecutor. This makes it difficult for the defense to challenge the testimony given by the witness.

With these weaknesses. SOSMA should be reviewed and repealed any part that is against human rights.
